Terms and conditions
The agreements that apply to every website, every care plan and every other service from Laerix.
This is a translation of the Dutch algemene voorwaarden. If the two differ, the Dutch version applies.
1. Scope
- These terms apply to all quotes, proposals, agreements and services of Laerix, the trade name of Sven Van Laere (sole proprietorship), Molenstraat 76, 9160 Lokeren, enterprise number 1043.606.766.
- The client is anyone who asks for a quote or makes an agreement with Laerix, as a business or as a consumer.
- Exceptions only apply when agreed in writing. An email is enough. The client's own terms and conditions don't apply.
2. Quotes and agreements
- A quote or proposal is valid for 30 days, unless it states a different period.
- The agreement starts as soon as the client accepts a proposal or package in writing, including by email.
- What a package or proposal includes is described on the pricing page or in the proposal. Anything not mentioned there isn't included.
3. Prices
- All prices are final. Laerix uses the special VAT exemption scheme for small businesses and therefore doesn't charge VAT.
- The domain name and email address are in the client's name. The client pays for them directly to their provider. Laerix adds no surcharge.
- Work outside the package or beyond the included time costs €25 per started quarter hour, unless a different price was agreed beforehand.
4. Payment
- When paying upfront, Laerix invoices half of the build price at the start and the rest at the launch.
- Monthly amounts are invoiced each month in advance.
- Invoices are payable within 14 days of the invoice date.
- If a payment is late, Laerix first sends a free reminder. If it still isn't paid after that, Laerix may charge the statutory interest and compensation, within the limits the law allows, and suspend the work or the care plan until it's paid.
5. Paying monthly
- When paying monthly, the client pays no build price upfront but a fixed monthly amount for 36 months. After that, the monthly amount drops to the package's regular price for hosting and care.
- The client can stop earlier at any time. They then pay the part of the build price that's still open (the build price × the months left ÷ 36), plus €150 for handing the website over. Together that's never more than the monthly payments still to come. Work out the amount.
- Payments already made are not refunded.
6. Hosting and care
- The care plan covers hosting, an SSL certificate, technical and security updates, support and the time included each month as described in the package.
- Included time is counted per started quarter hour. Unused time carries over for one month. The current month's time is used first, then the carried-over time. Anything left after that expires.
- When paying upfront, and after the 36 months when paying monthly, the care plan runs month to month. Either party can end it by email with one month's notice.
- Laerix does what is reasonable to keep the website online and secure, but can't guarantee it's never unavailable, for example during outages at hosting partners.
7. The client's input
- The client provides the texts, images, logos and access needed in time, such as access to the domain name. Delays caused by missing input move the schedule.
- The client is responsible for the content they provide or edit themselves, and guarantees they're allowed to use it.
- The number of revision rounds is stated in the package or proposal. Extra rounds are charged per started quarter hour.
8. Delivery
- Laerix delivers the website as soon as it's ready to launch. The client then has 14 days to report errors.
- The website counts as accepted at the launch, or 14 days after delivery if the client reports no errors.
9. Ownership
- The client keeps ownership of all content they provide.
- The design and code made for the client become theirs once the build price is paid in full. When paying monthly, that's after 36 months, or once the open amount is paid when stopping early.
- Laerix may keep using general knowledge, techniques and reusable parts that weren't made specifically for the client.
- Laerix may show the website in its portfolio, unless the client says they don't want that.
10. Liability
- Laerix carries out its work carefully and to the best of its ability.
- Laerix isn't liable for indirect damage, such as lost profit or lost data, nor for outages at third parties, such as hosting, email, domain registration or form services.
- Laerix's liability is limited to what the client paid for the service concerned in the 12 months before the damage.
- These limits don't apply in case of intent or gross negligence, nor where the law forbids them, for example towards consumers.
11. Right of withdrawal for consumers
- If you make an agreement at a distance as a consumer, for example by email or phone, you can withdraw from it without giving a reason within 14 days of making it. Let us know by email at info@laerix.be.
- If you explicitly ask to start within those 14 days, you pay an amount in proportion to what was already delivered when you withdraw. If the service was fully carried out with your explicit consent, the right of withdrawal lapses.
- Businesses have no right of withdrawal.
Model withdrawal form
You may use this form, but you don't have to. An email with the same details is enough.

12. Privacy
Laerix processes personal data as described in the privacy statement.
13. Complaints and disputes
- Please report complaints about an invoice or delivered work by email to info@laerix.be, preferably within 14 days.
- Belgian law applies. We first try to resolve a dispute together. If that doesn't work, the courts of the judicial district of East Flanders have jurisdiction. For consumers, the legal rules on the competent court apply.
- Consumers can also contact the Consumer Mediation Service.
